Regulations for the Subdivision of Agricultural and Agrotourism Lands


The management and development of land outside and within the Greater Metropolitan Area (GAM) in Costa Rica are governed by specific regulations that seek a balance between sustainable land use and rural development. Below, we detail the main guidelines that should be considered for the subdivision of these lands.


Minimum Required Areas


- Outside the GAM: The land must have a minimum area of ​​5,000 m².

- Within the GAM: The land must have a minimum area of ​​7,000 m²


Maximum Allowable Coverage


The maximum coverage allowed on these lands is 25%, distributed as follows:


1. Single-family home:

- Maximum area: 300 m².

- Distribution: One or two floors.


2. Houses for Workers and Agrotourism Infrastructure:

- They must be associated with agricultural activity.

- The sum of all these activities must not exceed 10% of the total coverage allowed.


Easements


Easements must have a minimum width of 7.00 meters, thus ensuring adequate access and circulation within the land.


Plot Visa Requirements


To obtain approval for these plots, it is necessary to have a document approving the soil study and the capacity of the land. This document must be issued by the Inspection Body of the National Institute of Innovation and Transfer in Agricultural Technology (INTA) and prepared by an authorized certifier of conforming land use.


Subdivision of Land for Agricultural Purposes


When there are properties in front of public streets intended for agricultural, livestock, forestry or mixed purposes, subdivision is allowed in areas of no less than 900 m². In these cases, no guarantee of water availability is required until the corresponding construction permit is processed.
